3. General Principles

3.1 What Data Do We Collect from You and from whom Do We Receive this Data

Primarily, we process personal data that you transmit to us or that we collect during the operation of our website. Under certain circumstances, we may also receive personal data about you from third parties. These may include the following categories:

  • Personal master data (name, address, date of birth, etc.);
  • Contact data (mobile number, email address, etc.);
  • Financial data (e.g., account details);
  • Online identifiers (e.g., cookie identifier, IP addresses);
  • Location and traffic data;
  • Audio and video recordings;
  • special categories of data (e.g., biometric data or information about your health).

3.2 under What Conditions Do We Process your Data?

We treat your data confidentially and in accordance with the purposes set out in this privacy policy. We ensure transparent and proportionate processing.

If, exceptionally, we are unable to comply with these principles, data processing may still be lawful if there is a legal justification. Legal justifications include, in particular:

  • Your consent;
  • the performance of a contract or pre-contractual measures;
  • our legitimate interests, provided that your interests do not override them.

3.3 how Can You Withdraw your Consent?

If you have given us consent to process your personal data for specific purposes, we process your data within the scope of this consent, unless we have another legal justification.

You have the option to withdraw your consent at any time by sending an email to the address provided in the imprint. Data processing that has already occurred is not affected by this.

3.4 in What Cases Can We Disclose your Data to Third Parties?

A. Principle

Under certain circumstances, we may rely on the services of third parties or affiliated companies and commission them with the processing of your data (so-called processors). Categories of recipients include:

  • Accounting, fiduciary, and auditing firms;
  • Consulting firms (legal advice, taxes, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Payment service providers;
  • Providers of tracking, conversion, and advertising services.

We ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially.

Under certain circumstances, we may also be obliged to disclose your personal data to authorities.

B. Visiting our Social Media Channels

We may have embedded links to our social media channels on our website. This is visible to you (typically via corresponding icons). If you click on the icons, you will be redirected to our social media channels.

In this case, the social media providers will know that you are accessing their platform from our website. The social media providers may use the data collected in this way for their own purposes. Please note that we do not receive any information about the content of the transmitted data or its use by the operators.

C. Data Transfer Abroad

Under certain circumstances, your personal data may be transferred to companies abroad as part of order processing. These companies are obliged to protect data to the same extent as we are. The transfer can take place worldwide.

If the level of data protection does not correspond to that in Switzerland, we carry out a prior risk assessment and contractually ensure that the same level of protection as in Switzerland is guaranteed (e.g., by means of the new standard contractual clauses of the EU Commission or other legally prescribed measures). Should our risk assessment turn out negative, we will take additional technical measures to protect your data. You can access the standard contractual clauses of the EU Commission at the following link. https://commission.europa.eu/publications/standard-contractual-clauses-controllers-and-processors-eueea_de

3.5 how Long Do We Store your Data?

We store personal data only for as long as necessary to fulfill the individual purposes for which the data was collected.

Data that we store during your visit to our website is retained for twelve months. An exception applies to analytics and tracking data, which may be retained longer.

We store contract data longer, as we are obliged to do so by legal regulations. In particular, we must retain business communications, concluded contracts, and booking receipts for up to 10 years. Insofar as we no longer require such data from you for the performance of services, the data will be blocked, and we will only use it for accounting and tax purposes.

3.6 how Do We Protect your Data?

We will keep your data secure and take all reasonable measures to protect your data from loss, access, misuse, or alteration.

Our contractual partners and employees who have access to your data are obliged to comply with data protection regulations. In some cases, it will be necessary for us to forward your inquiries to affiliated companies. Even in these cases, your data will be treated confidentially.

Within our website, we use the SSL (Secure Socket Layer) procedure in conjunction with the highest encryption level supported by your browser.

3.7 What Rights Do You Have?

A. Right of Access

You can request information about the data we store about you at any time. We ask you to send your request for information along with proof of identity to manuel.bobrich@szb-chb.ch.

You also have the right to receive your data in a common file format if we process your data automatically, and if:

  • You have given your consent for the processing of this data; or
  • You have disclosed data in connection with the conclusion or performance of a contract.

We may restrict or refuse access to or disclosure of data if this conflicts with our legal obligations, legitimate own or public interests, or the interests of a third party.

The processing of your request is subject to the statutory processing period of 30 days. However, we may extend this period due to high request volume, legal or technical reasons, or because we require further information from you. You will be informed of the extension of the period in good time, at least in text form.

B. Deletion and Rectification

You have the option to request the erasure or rectification of your data at any time. We may reject the request if legal regulations oblige us to retain the data for a longer period or unchanged, or if a permissible circumstance conflicts with your request.

Please note that the exercise of your rights may, under certain circumstances, conflict with contractual agreements and may have corresponding effects on the performance of the contract (e.g., premature termination of contract or cost implications).

C. Legal Recourse

If you are affected by the processing of personal data, you have the right to enforce your rights in court or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner: https://www.edoeb.admin.ch

3.8 Changes to the Privacy Policy

We may amend this privacy policy at any time. The changes will be published here, you will not be separately informed about them.

4. Individual Data Processing Operations

4.1 Provision of the Website and Creation of Log Files

What Information Do We Receive and how Do We Use it?

By visiting our website, certain data is automatically stored on our servers or on servers of services and products that we obtain and/or have installed, for purposes of system administration, for statistical or backup purposes, or for tracking purposes. This includes:

  • the name of your internet service provider;
  • your IP address (under certain circumstances);
  • the version of your browser software;
  • the operating system of the computer used to access the URL;
  • the date and time of access;
  • the website from which you visit the URL;
  • the search terms you used to find the URL.

Why are We Allowed to Process this Data?

This data cannot be assigned to any specific person, and no merging of this data with other data sources takes place. Log files are stored to guarantee the functionality of the website and to ensure the security of our information technology systems. This constitutes our legitimate interest.

How Can You Prevent Data Collection?

The data is stored only for as long as necessary to achieve the purpose of its collection. Accordingly, the data is deleted after each session. The storage of log files is absolutely necessary for the operation of the website, so you have no possibility to object to it.

4.2 Brevo (Formerly Sendinblue)

Our website uses the service of Brevo, formerly known as Sendinblue, for email communication, as a CRM (Customer Relationship Management), and for the ChatWidget for direct communication with our visitors.

If you subscribe to our newsletter, send an inquiry via our contact forms, or use other forms of email communication with us, your email address and, if applicable, other personal data, such as your name or preferences, will be stored and transmitted to Brevo for processing. Brevo uses technologies such as cookies or tracking pixels to determine whether emails have been opened and which links within them have been clicked. This helps us measure the effectiveness of our email campaigns and better respond to the interests and needs of our users.

As a CRM tool, Brevo helps us manage and optimize our customer relationships. This means that we store information about our customers and prospects, such as contact data or interactions with our website, in Brevo to gain a better overview of our customer relationships and adapt our services accordingly.

The ChatWidget from Brevo, which may be integrated on our website, allows you to communicate directly with us. If you use this widget, the data you enter, as well as technical information such as your IP address, will be stored and transmitted to Brevo for processing.

4.3 Google Ads

On our website, we use the Google Ads service, an online advertising service of Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter “Google”). Google Ads allows us to display advertisements in Google search results and on the Google advertising network.

4.4 Google Ads Conversion Tracking

On our website, we use the online advertising program “Google Ads” and, in this context, Conversion Tracking (visit action evaluation). Google Ads Conversion Tracking is an analytics service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”).

When you click on an ad placed by Google, a cookie for conversion tracking is placed on your device. These cookies have a limited validity, do not contain any personal data, and therefore do not serve for personal identification. If you visit certain pages of our website and the cookie has not yet expired, Google and we can recognize that you clicked on the ad and were redirected to this page.

The information obtained with the help of the conversion cookie is used to generate conversion statistics. This tells us the total number of users who clicked on one of our ads and were redirected to a page with a conversion tracking tag. However, we do not receive any information that allows users to be personally identified.

You can prevent the storage of cookies by selecting appropriate technical settings in your browser software. However, we point out that in this case, you may not be able to use all functions of this website to their full extent. You will then not be included in the conversion tracking statistics.

Furthermore, you can disable personalized advertising for you in the Google ad settings. Instructions for this can be found at https://support.google.com/My-Ad-Center-Help/answer/12155764.

4.5 Meta Ads

Our website uses Meta Ads, an online advertising service from Meta Platforms, Inc., 1601 Willow Road, Menlo Park, CA 94025, USA (formerly known as Facebook, Inc.). With the help of Meta Ads, we can display targeted advertisements to draw users’ attention to our products or services.

When you visit our website, a cookie may be placed on your device via Meta Ads, which enables an analysis of your website usage. In addition, Meta can use this cookie to track your usage behavior across various websites and devices and display personalized advertisements based on this.

The data collected by the cookie is transmitted to Meta and stored there. This data can be linked by Meta to your Meta account (formerly Facebook account) and used for its own advertising purposes.

To generally object to the use of cookies on your computer, you can set your internet browser so that no more cookies can be stored on your computer in the future or already stored cookies are deleted. However, disabling cookies may result in some functions of our website no longer working correctly.

Further information on the handling of user data by Meta Ads can be found in Meta’s privacy policy: https://www.facebook.com/privacy/policy/. If you do not want Meta to use data for advertising purposes, you can adjust the corresponding settings in your Meta account.

4.6 Microsoft Advertising

On our website, we use Microsoft Advertising, an online advertising service of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA. With the help of this service, we can display targeted advertisements to present our products and services.

Microsoft Advertising uses cookies and similar technologies to collect data about the use of our website and interaction with our ads. This data may include information such as IP address, browser type, pages visited, date and time of access, and response to advertisements.

The data collected by the cookies is used to measure the effectiveness of our advertisements, optimize our marketing strategies, and display targeted advertising based on user interests.

4.7 Google Analytics

On our website, we use Google Analytics, a web analytics service of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Analytics uses so-called “cookies”, text files that are stored on your computer and enable an analysis of your use of the website.

The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, if IP anonymization is activated on this website, your IP address will be truncated by Google within member states of the European Union or other contracting states to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there.

On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services related to website and internet usage to the website operator.

The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

You can prevent the storage of cookies by adjusting your browser software settings accordingly; however, please note that in this case, you may not be able to use all functions of this website to their full extent. Furthermore, you can prevent Google from collecting and processing the data generated by the cookie and related to your use of the website (including your IP address) by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout.

4.8 Google Call Conversion Tracking

On our website, we use Google Call Conversion Tracking, an analytics service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). This service allows us to measure the effectiveness of certain advertisements by tracking how many calls are generated through these ads.

If you reach our website via a Google ad and call the provided phone number, Google can recognize this and record it as a “conversion” for us. No personal data of the caller, such as phone number or name, is transmitted to us in this process.

Google uses cookies and similar technologies to provide the service and track calls. These cookies are used to identify and track the advertisement that led the user to the website and the source of the call.

If you do not wish to participate in tracking, you can object to this use by deactivating the Google Conversion Tracking cookie via your internet browser’s user settings. You will then not be included in the conversion tracking statistics.

4.9 Google Tag Manager

For managing website tags via an interface, we use Google Tag Manager, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Tag Manager itself (which implements the tags) is a cookie-less domain and does not process any personal data. The service ensures the triggering of other tags, which in turn may collect data. Google Tag Manager does not access this data. If a deactivation has been made at the domain or cookie level, this remains in effect for all tracking tags implemented with Google Tag Manager.

By using Google Tag Manager, scripts (so-called tags) can be automatically activated on our website, and data can be transmitted from your browser to Google. This data may include information about your IP address, the browser you use, the subpages of our website visited, and other interactions during your website visit.

4.10 Google Customer Reviews

On our website, we use the Google Customer Reviews service, offered by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Customer Reviews allows our customers to provide feedback on their purchasing experiences with us and helps us improve our service quality and customer experience.

After a purchase on our website, you may be invited to participate in a Google Customer Reviews survey. If you choose to participate, Google will provide you with a survey where you can rate your experience with us. The information you provide will be processed and aggregated by Google to give us an overall picture of customer satisfaction.

When using Google Customer Reviews, data, including your IP address, date and time of the survey, and your ratings, are transmitted to Google and stored on Google’s servers. These servers may be located in the USA or other countries.

If you do not wish to participate in Google Customer Reviews, you can simply ignore or decline the survey invitation.

Further information on Google’s data collection and privacy practices regarding Google Customer Reviews can be found in Google’s privacy policy at https://www.google.de/intl/de/policies/privacy/ and in the specific information on Google Customer Reviews.

4.11 Google My Business

On our website, we use features of Google My Business, a service provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google My Business allows businesses to manage their presence on Google, including Google Search and Google Maps, and interact with customers.

By visiting our website or interacting with our Google My Business listing, such as leaving reviews or asking questions, data, particularly your IP address and the content of your interactions, is transmitted to Google and stored on Google’s servers. These servers may be located in the USA or other countries.

Google uses this information to provide Google My Business services, facilitate user interactions with businesses, and provide us with reports and analyses on the interactions and performance of our business listing.

4.12 Vimeo

Vimeo is a service provided by Vimeo Inc., 555 West 18th Street, New York, New York 10011, USA. Vimeo is a platform that allows users to upload, share, and view videos. It also offers various tools for video producers to monetize their content and interact with their audience.

We use Vimeo to embed videos on our website and provide our visitors with high-quality visual content. This may include product presentations, tutorials, or other content relevant to our users. By embedding Vimeo videos, our visitors can watch them directly on our website without being redirected to the Vimeo platform.

When you access a page of our website that contains a Vimeo video, your browser establishes a direct connection to Vimeo’s servers. Certain information is transmitted to Vimeo in this process. This also includes the user’s IP address. Vimeo also uses cookies and similar technologies to collect information about the use of the service and to improve the user experience.

4.13 YouTube

Videos from YouTube, a platform of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”), are embedded on our website. When displaying the videos or clicking the play button, data, including your IP address and information about the browser you are using, is transmitted to Google’s servers and stored there. This data is used to provide the video, monitor performance, and improve the user experience.

If you are logged into your YouTube account, you enable YouTube to directly associate your browsing behavior with your personal profile. You can prevent this by logging out of your YouTube account.

4.14 Cookiebot

Our website uses Cookiebot, a cookie consent and compliance service from Cybot A/S. Cookiebot helps us obtain and manage our users’ consent for cookies and online tracking in accordance with legal requirements.

When you visit our website, Cookiebot may collect information about your consent decisions and your interaction with the consent pop-up. This information is used to ensure that only the cookies and tracking technologies you have approved are activated on your device.

4.15 Google Site Kit

For the management and analysis of our website, we use the plugin “Google Site Kit”, provided by Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). Google Site Kit allows us to integrate and centrally manage various Google services, such as Google Analytics, Google Search Console, Google AdSense, and others, directly into our WordPress website.

By using Google Site Kit, various data, including your IP address, information about the browser you use, the subpages of our website visited, and other interactions during your website visit, are transmitted to Google and stored on Google’s servers. These servers may be located in the USA or other countries.

Google uses this information to provide us with detailed reports and analyses on website traffic, our website’s performance, visitor interactions, and other relevant metrics.

4.16 WordPress

Our website is based on the WordPress platform, a content management system developed by Automattic Inc., 60 29th Street #343, San Francisco, CA 94110, USA. WordPress allows us to create, manage, and publish content.

When using our WordPress-based website, various data, including your IP address, date and time of access, and information about the browser you use, may be collected and stored. This data is primarily used for administrative purposes and to ensure the smooth operation of the website.

Some WordPress features, such as comments or contact forms, may collect additional personal data if you use them.

4.17 Google reCaptcha

To protect against unwanted requests via the internet form on our website, we use the reCAPTCHA service from Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The query serves to distinguish whether the input is made by a human or abusively by automated, machine processing. As part of the query, information such as your IP address or behavior when filling out the form may be transmitted to Google.

For this purpose, your input is transmitted to Google and further processed there. By using reCAPTCHA, you agree that the recognition you perform contributes to the digitization of old works. However, if IP anonymization is activated on this website, your IP address will be truncated by Google within member states of the European Union or other contracting states to the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of this service. The IP address transmitted by your browser as part of reCAPTCHA will not be merged with other Google data.

4.18 Google reCaptcha V2 for Contact Form 7

To protect your inquiries via the internet form on our website, we use the reCAPTCHA v2 service from Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; “Google”). The query serves to distinguish whether the input is made by a human or abusively by automated, machine processing. The query includes the transmission of your IP address and, if applicable, other data required by Google for the reCAPTCHA service to Google.

For this purpose, your input is transmitted to Google and further used there.
